The Attorney-General has expressed confidence that the Supreme Court will overturn the Court of Appeal’s decision acquitting former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Sedina Attionu Tamakloe, after directing the Director of Public Prosecutions (DPP) to challenge the ruling.

The Attorney-General’s Office has instructed the DPP to file a notice of appeal at the Supreme Court, along with an application for a stay of execution of the Court of Appeal’s judgment pending the final determination of the case.

Ms. Tamakloe had been prosecuted on 78 counts, including conspiracy to steal, stealing, conspiracy to cause financial loss to the state, causing financial loss to the state, causing loss to public property, improper payment of public funds, unauthorised commitments resulting in financial obligations to government, money laundering, and breaches of the Public Procurement Act.

She was tried in absentia before the High Court (Financial Division 2), presided over by Justice Afia Serwaa Asare-Botwe, where she was convicted and sentenced to 10 years’ imprisonment.

The Attorney-General’s Office noted that the Republic had vigorously opposed Ms. Tamakloe’s appeal before the Court of Appeal by filing written submissions, arguing that the appeal lacked merit and should be dismissed.

Despite those submissions, the Court of Appeal overturned the High Court’s decision and acquitted the former MASLOC boss, prompting the Attorney-General to seek a review of the ruling by the Supreme Court.

According to the Attorney-General’s Office, the application for a stay of execution is intended to suspend the effect of the Court of Appeal’s judgment until the Supreme Court delivers its final decision.

In announcing the move, the Attorney-General reaffirmed the government’s commitment to pursuing the matter through the judicial process and expressed confidence in the outcome.

“The Attorney-General remains committed to the due process of law and is confident that the appeal before the Supreme Court will succeed.”

ATTORNEY GENERAL TO APPEAL DECISION OF THE COURT OF APPEAL IN REPUBLIC V. SEDINA TAMAKLOE

The attention of the Attorney-General has been drawn to the decision of the Court of Appeal acquitting the former Chief Executive Officer of the Microfinance

and Small Loans Centre (MASLOC), Ms Sedina Attionu Tamakloe, of all the charges brought against her.

Ms. Tamakloe was charged with seventy-eight (78) counts of various offences, including conspiracy to steal, stealing, conspiracy to cause financial loss to the

State, causing financial loss to the State, causing loss to public property, improper payment of public funds, unauthorized commitments resulting in financial obligations to the Government, money laundering, and breaches of the Public Procurement Act.

She was tried and convicted in absentia by the High Court (Financial Division 2), presided over by Her Ladyship Justice Afia Serwaa Asare-Botwe, JA, sitting as an additional High Court Judge. Upon her conviction, she was sentenced to ten (10) years’ imprisonment.

The Republic opposed the appeal by filing written submissions, contending that the appeal lacked merit and ought to be dismissed.

Having received notice of the Court of Appeal’s decision, the Attorney-General has directed the Director of Public Prosecutions to immediately file a notice of appeal to the Supreme Court, together with an application for a stay of execution of the judgment pending the determination of the appeal.

The Attorney-General remains committed to the due process of law and is confident that the appeal before the Supreme Court will succeed.
